1. Introduction

These Terms and Conditions ("Terms") govern the photography services provided by iNNOVATIONphotography ("Photographer") for the Plough Colts Presentation Evening ("Event") at Penlan Social Club.

2. Photography Services

The Photographer will capture individual portraits of participating children from the Plough Colts Club. These portraits will be available for purchase and download through an online gallery.

3. Parental Consent

By allowing your child to participate in the individual portrait session, you (the "Parent/Guardian") grant the Photographer permission to photograph your child and agree to these Terms.

4. Image Usage

The photographs ("Images") are licensed for personal use only. Parents/Guardians may download, print, and share the Images for personal, non-commercial purposes.

5. Image Ownership and Copyright

The Photographer retains full ownership and copyright of all Images. The license granted in Section 4 does not transfer ownership or copyright.

6. Data Protection and GDPR

The Photographer is committed to protecting the privacy of all individuals, including children.

• Data Collection:
• The Photographer will only collect the following information from Parents/Guardians: name, email address. This information is necessary to deliver the online gallery link and facilitate ordering of photographs.
• The Photographer will not collect any personal information from children directly.
• Data Storage:
• All data collected will be stored securely and in accordance with GDPR regulations.
• Parents/Guardians have the right to access, modify, or delete their personal information at any time by contacting the Photographer.
• Data Sharing:
• The Photographer will not share personal information with any third parties without the explicit consent of the Parent/Guardian.

7. Image Retention and Opt-Out

Images will be stores in the online gallery for future orders or for archive for a period of time. 

Parents/Guardians have the right to withdraw their consent for the use of their child's image at any time by contacting the Photographer. In such cases, the Photographer will remove the child's image from the online gallery and delete any associated data.

8. Right to Use Images for Marketing

The Photographer reserves the right to use a limited number of images for marketing purposes, such as on the Photographer's website/portfolio or social media platforms. Parents/Guardians who do not wish for their child's image to be used for marketing purposes can opt-out by contacting the Photographer.

9. Disclaimer

The Photographer will use reasonable efforts to capture high-quality Images. However, the Photographer cannot guarantee specific poses, expressions, or backgrounds.

12. Entire Agreement
